THESE MYCHART TERMS AND CONDITIONS ("TERMS AND CONDITIONS") GOVERN YOUR USE OF MYCHART AND THIS WEB SITE ("WEB SITE"). IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, DO NOT ACCESS OR USE MYCHART.
THE USE OF MYCHART IS COMPLETELY VOLUNTARY AND IS NOT REQUIRED TO RECEIVE HEALTH CARE FROM BON SECOURS. "BON SECOURS" MEANS BON SECOURS HEALTH SYSTEM, INC., 1505 MARRIOTSVILLE ROAD, MARRIOTSVILLE, MD 21104, AND ITS CONTROLLED AFFILIATES THAT OWN AND/OR OPERATE ONE OR MORE HOSPITALS OR PHYSICIAN PRACTICES LOCATED IN FLORIDA, KENTUCKY, MARYLAND, NEW YORK, SOUTH CAROLINA OR VIRGINIA. BON SECOURS IS SOMETIMES REFERRED TO AS "WE," "US," OR "OUR" IN THESE TERMS AND CONDITIONS.

MyChart should not be used to communicate urgent matters to your health care provider - please call your physician's office if you have an urgent question or concern.
When we provide health care services, we are required by law to maintain records that document your care, including (but not limited to) medical history, current health status and relevant diagnoses regarding acute or chronic conditions or problems, all test results and reports, and any treatments, therapies or procedures provided or performed. We may maintain your information in paper format or electronically - or a combination of both. For purposes of these Terms and Conditions, "electronic medical record" means the electronic portion of your medical record.
MyChart provides you with access to some (but not all) of the information contained in your electronic medical record. Sometimes, MyChart shows a summary or a description of your information, and not the actual entries made by a physician that are otherwise included in your physician or hospital-based medical record. As a result, you should not rely on information accessed via MyChart as complete.
If you need a complete medical record, please make your request through the established procedures for requesting medical records of the physician practice or hospital where you are receiving your medical care.
MyChart may be available for adult (18 and older) patients of Bon Secours who have an electronic medical record at a Bon Secours physician practice or hospital system where MyChart has been implemented. MyChart may also be available to legal representatives, guardians and/or other authorized persons who may act as health care proxies of Bon Secours patients. If you are not within this group of authorized persons, you are not permitted to use MyChart.
When you log into MyChart as the authorized proxy of a Bon Secours patient, these Terms and Conditions apply to you. In such circumstances, references to "your information," "your medical record." "your health care provider" and similar references shall be deemed to refer to the information, medical record, health care provider of the Bon Secours patient for whom you have been granted proxy access. Bon Secours maintains a separate process for establishing proxy access through a Bon Secours facility, such as a physician's practice office or a hospital. Generally, if a person is permitted under state law to serve as a proxy for a Bon Secours patient, then that person will be afforded proxy access. If a Bon Secours patient revokes proxy access, then the proxy's access to such patient's MyChart information will be revoked. Bon Secours reserves the right to revoke proxy access at any time for any reason.
We may modify these Terms and Conditions at any time. Any modifications made to these Terms and Conditions will be effective immediately upon your agreement to such modified terms or your continued use of MyChart (whichever occurs first). Any aspect of MyChart may be changed, supplemented, deleted or updated with or without notice at the sole discretion of Bon Secours.
MyChart includes a feature that permits you to send an electronic message to a doctor's office. Your messages should only relate to your own health condition(s) or those of a person for whom you are acting as a health care proxy (such as a child). We will try to respond promptly to messages we receive, but in some cases, the staff that needs to respond to your message or other inquiry may not be available immediately. Accordingly, please allow at least two (2) business days for a response to your message.
Emergency situations requiring immediate attention should not be submitted electronically through MyChart. If you are experiencing a medical emergency, GO TO THE EMERGENCY DEPARTMENT OF A LOCAL HOSPITAL OR DIAL 911. If you have an urgent need to contact your doctor's office, please do so by telephone.
Any electronic message you send through MyChart will be reviewed initially by a member of Bon Secours' clinical staff, usually a nurse. If physician input is not needed to address your message, your message may not be reviewed by a physician. Messages you send (and our responses) may be made a part of your permanent medical record. Furthermore, we are only able to respond to messages based on the information you provide. If insufficient or incorrect information is provided, we may not be able to provide a proper response. It is your obligation to monitor MyChart for responses to your messages and for messages originating from your doctor's office. In some circumstances your doctor's office may choose to respond to you through a method other than MyChart (such as by telephone).
If you provide us with an email address, you will be notified whenever you have been sent a message through MyChart and when there is new medical information to be viewed on MyChart. Please remember that this means anyone with access to your email account would be able to see this notification, including a spouse, employer or anyone else able to access your email account. Although no private medical information will be included in a notification email, the notification that new medical information is available on MyChart may be information that you would not want others to know. This should be taken into account when making a decision about providing an email address.
MyChart may offer links to medical-related web sites operated by third parties. These links are provided for your convenience only. Bon Secours does not control or endorse such web sites, and we are not responsible for the content or performance of these sites. The inclusion of links to these web sites does not imply any endorsement of the material on the web sites or any association with their operators. Bon Secours does not operate, control or endorse any information, products or services provided by third parties through the internet. Use of third party sites is strictly at your own risk including, but not limited to, any risks associated with destructive viruses. You are responsible for viewing and abiding by the terms and conditions of use and the privacy statements of these other web sites. You should not rely on any of the information found on these web sites for purposes of diagnosis or treatment.
Notices of Privacy Practices applicable to you are available from your physician practice and from the hospital where you receive treatment. These notices explain how health information about you may be used and disclosed, and your rights with respect to your health information.
Bon Secours MyChart is accessed through a secure, password-protected web site. The security of any data you submit via MyChart is very important to us. This site uses encryption technology, and we regularly review our security practices to help ensure that your data is maintained securely.
However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information sent to us. Moreover, when you transmit information via the public Internet, your information will be transmitted over a medium that is beyond our control, and therefore the security of the transmission may be compromised before it reaches us. Accordingly, Bon Secours can make no guarantee as to confidentiality or security. In addition, by using MyChart you hereby expressly and solely assume the risk of any unauthorized disclosure or intentional intrusion, or of any delay, failure, interruption of corruption of data or other information transmitted in connection with the use of MyChart.
Your user name and password should be kept confidential. Failure to do so may also compromise the confidentiality of your information.

You agree that the laws of the Commonwealth of Virginia, without regard to principles of conflict of laws, will govern these Terms and Conditions, and any dispute that might arise with respect thereto between you and Bon Secours or our or their officers, directors, employees or agents. You expressly and irrevocably agree that exclusive venue and jurisdiction for any such dispute shall be in the state courts of the City of Richmond, Virginia, or in the United States District Court for the Eastern District of Virginia, Richmond Division, and you further expressly and irrevocably consent to the exercise of personal jurisdiction in such courts in connection with any such dispute.
To the extent any portion of these Terms and Conditions is determined to be unenforceable by a court of competent jurisdiction, such portion will be modified solely to the extent necessary to cause such portion to be enforceable, and these Terms and Conditions, as modified, will remain in full force and effect.
